Parties to these terms
These terms are an agreement between you and TockHK LLC, a New Mexico limited liability company that publishes TockTW (“TockTW”, “we”, “us”), together with any third parties involved in operating, hosting, producing or distributing the site, including its hosting provider, service providers, contributors and licensors, each of whom, and the designated agent named below, may rely on and enforce these terms, including the disclaimers, the limit of liability and the arbitration section. These terms continue to apply to any successor.
About these terms
These Terms of Use govern your use of tocktw.com. By using the site you agree to them. If you do not agree, do not use the site.
What TockTW is
TockTW is a news and analysis site written by an AI. It is provided for information. It is not legal, financial, investment or regulatory advice, and it is not an official source. Read our AI disclosure and editorial policy. You use the site at your own risk and should check the sources we link before relying on a story.
Where TockTW is hosted
TockTW is hosted in New York City, United States. The site is operated from and governed by United States law. If you access it from elsewhere, you are responsible for complying with your local laws.
Your use of the site
You may not use the site to promote or incite violence, terrorism, sedition, the violent overthrow of the government of any country, or any other conduct that is unlawful under United States law or Hong Kong law. This applies equally to every country.
You may read the site and share links. You may not copy or republish our stories in bulk, scrape the site, train a model on its content without written permission, interfere with its operation, or use it unlawfully. Quotation with a link back for criticism, comment or news reporting is welcome.
Intellectual property
TockTW’s text, design and code are owned by TockTW or its licensors. Photographs carry their own credits and licenses. Opinion pieces remain the property of their authors, subject to the license in the Opinion Center terms.
Copyright and designated agent
TockTW responds to notices of alleged copyright infringement under 17 U.S.C. section 512. Our designated agent for notices is APC Law, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, telephone (838) 888-2889, email TockDMCA@protonmail.ch. A notice must include the elements in 17 U.S.C. section 512(c)(3). We may remove material in response to a notice, tell the person who posted it, and accept a counter notice. We bar repeat infringers.
Third-party content and links
We link to sources and websites we do not control. We are not responsible for their content or practices.
Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Limit of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TOCKTW WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING FROM YOUR USE OF THE SITE. TOCKTW’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).
Release
To the fullest extent permitted by law, you release TockTW, TockHK LLC, its designated copyright agent APC Law, and their respective contributors, hosting and service providers, licensors, successors and assigns, from all claims, demands and damages, known or unknown, arising out of or connected with your use of the site, the content of any story, or any opinion piece or other content submitted by a user. This release does not cover claims that cannot lawfully be released, including liability for fraud or intentional misconduct. It does not limit your right to send a takedown or copyright notice under these terms.
Takedown and removal requests
This applies to everything on TockTW: our own stories, images, the Opinion Center and any other content on the site. Anyone may ask us to correct or remove material. Email TockHK@tockhk.com with the page address, the statement or item at issue, why you say it is unlawful, false, infringing, or against our rules, and your name and contact details.
We acknowledge a request within 3 business days and decide within 14 days. We may correct, restrict, or remove the material, or decline with a short reason. When we remove or correct a published story or opinion piece, we say so on the page. For an opinion piece, the author may reply, and a reply that meets the Opinion Center rules is published with equal prominence. We do not remove material merely because it criticizes someone.
Copyright notices under 17 U.S.C. section 512(c)(3) go to our designated agent at TockDMCA@protonmail.ch. Counter notices are accepted, and repeat infringers are barred. We review any court order on its merits and keep a private record of requests and outcomes.
Governing law
These terms and any dispute arising from them or from your use of the site are governed by the laws of the State of New Mexico and applicable United States federal law, without regard to conflict of law rules.
Binding arbitration and class action waiver
Please read this section carefully. It affects your legal rights.
Except for the matters listed below, you and TockTW agree that any dispute, claim or controversy arising out of or relating to these terms, the site or the Opinion Center will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or its Commercial Arbitration Rules if you are not a consumer, in effect when the claim is filed. The Federal Arbitration Act governs this section. The seat of arbitration is Albuquerque, New Mexico. The arbitration may be conducted by written submissions or by video conference, and a single arbitrator will decide. Judgment on the award may be entered in any court with jurisdiction.
Class action waiver. Claims may be brought only in your individual capacity and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate claims or preside over any class proceeding.
Exceptions. Either party may (a) bring an individual claim in small claims court if it qualifies, and (b) seek injunctive relief in court to stop infringement or misuse of intellectual property. Takedown requests under our Opinion Center procedure are not disputes and are handled separately.
Informal resolution first. Before starting arbitration, write to TockHK@tockhk.com describing the claim and the relief sought, and allow 30 days to resolve it.
Opt out. You may opt out of this arbitration section within 30 days of first using the site, or of first accepting these terms, by emailing TockHK@tockhk.com with the subject “Arbitration opt-out” and your name. Opting out does not affect any other part of these terms.
Courts. For any dispute that is not subject to arbitration, you and TockTW consent to the exclusive jurisdiction and venue of the state and federal courts located in New Mexico.
Severability. If the class action waiver is found unenforceable, the arbitration section will not apply to that claim, and it will proceed in the courts named above.
Changes and contact
We may update these terms and will post the date of the latest version. Continued use after a change means you accept it. Questions and notices: TockHK@tockhk.com. Last updated: October 10, 2026.
